In this privacy policy (the “Privacy Policy”), we provide information about what personal data we process and for what purpose, to whom we may transfer it and for how long we keep it, what rights you have as a data subject and other important information related to the processing of your personal data.

APPLICATION OF THE PRIVACY POLICY

This Privacy Policy is applicable to persons who visit the website https://roomradius.com (the “website”), use or intend to use our services, contact us, enter into contracts with us, represent other persons in such persons’ dealings with us or are the managers or other legal representatives of the legal entities who use or intend to use our services. This Privacy Policy also applies to the persons whose personal data is collected by us when offering our services to our clients/ users of the website.

By browsing the website, creating user account on the website, you confirm that you have read and understood the Privacy Policy and how we process your personal data.

If we collect your personal data from various websites during the process of offering our services to our clients/ users of the website who search for the accommodation to their workers on the basis of legitimate interest you will be notified of our processing of your data in accordance with this Privacy Policy by separate e-mail together with our client’s inquiry to receive the accommodation rental services as offered by you publicly on other websites. Once you receive such e-mail we encourage you to visit our website and to read the Privacy Policy carefully so that you can use your data subject’s rights.

WHERE AND WHAT INFORMATION WE GET ABOUT YOU

We receive your personal data directly from you when you create your user account on the website, submit enquiries to us, fill in applications for the provision of services by roomRadius, or any other documents requested by us.

We process the following personal data when you create the user account and use our services on the website:

  • identification data: name(s), surname(s);
  • your details as a representative of the company/person you represent: name(s), surname(s);
  • contact details: residential address, address of the company you represent, telephone number, e-mail address;
  • the details of the services you are going to order and ordered services on the website, which also includes the location of accommodation you are looking for rent;
  • your user account login data: username and password (password will be saved in an encrypted form and will not at any point be visible in plain text);
  • payment information: i.e. information about the paid-up credit points; usage of the credit points acquired on the website, if you make a payment by bank transfer – the amount you paid, your bank account number, your identification data.

We emphasize that the payment card details (issuer, card holder, card number, card expiration date) will be processed and payment card data will be processed by third-party payment service provider Stripe for handling of payments and for fraud prevention. When you make enquiries, you provide us with the personal data specified in the relevant enquiry, such as: name, surname, e-mail address.

During the process of services provision to our clients/ users of the website we may receive information about you indirectly from the various websites on which you published information about your offered accommodations for rent which may also include information on location of the accommodation you offer for rent. In such aspect we also perform the public information function allowing users of our website to become aware of the possible accommodation for their workers. We will collect such data on the ground of legitimate interest, the scope of the data we collect will not be wider than you entered into other websites for offering your services publicly.

FOR WHAT PURPOSES WE PROCESS YOUR PERSONAL DATA

We generally process (may process) your personal data for the following purposes:

  • to offer our services on the website to its users;
  • to verify the identity of persons who use our services;
  • administering, responding to your enquiries or resolving problems;
  • for our internal administration, bookkeeping, fulfilling our obligations to third parties (our clients/ website users);
  • collecting and administering debts, making, pursuing and defending legal claims, defending us against actions and complaints;
  • communication;
  • direct marketing on the basis of your consent or legitimate interest, where applicable;
  • optimising performance of our website;
  • statistical;
  • getting your opinion (feedback) about us;
  • compliance with the applicable laws;
  • to perform public information function to inform users of our website about accommodations placed for rent.

For the purposes set out in this section, we process your personal data where we are obliged to do so by law, by a contract with you, in our legitimate interest or in legitimate interest of users of our website, or where we have obtained your consent to process your personal data.

Processing of PERSONAL Data for direct marketing purposes

When we process your personal data for the purpose of direct marketing, we ask for your consent to such processing, unless our basis of such processing is legitimate interest. If you provide your consent, you may withdraw it at any time by contacting us at the email address set out in the Privacy Policy or by any other means of which we will inform you separately.

For direct marketing purposes on the basis of your consent, we will process personal data for a maximum period of 3 years from the receipt of your consent or until you withdraw your consent to processing for this purpose, whichever is earlier.

STORAGE PERIOD FOR PERSONAL DATA

We ensure that your personal data is processed for a period no longer than is necessary to achieve the purposes of the processing, and for a period no longer than is required by law.

We will store your data as long as your account on the website is not cancelled and for a period of 3 years after your account on the website is cancelled, unless longer periods are necessary for the purpose of making legal claims, defending legal interests or longer retention periods are required to comply with statutory requirements. Any payment information will be stored for a period of 10 years.

If you do not create the account on the website but refer to us with your enquiries we will store your personal data for a period of 2 months.

If you have not completed the registration process and/or your account registration have not been confirmed by us, your personal data provided for registration purposes will be stored for 2 months from the start date of the registration attempt or rejection of such registration whichever is later.

If we collect personal information related to your published accommodation for rent during the process of rendering services to our clients/ users of the website, we will store such information as long as we do not receive from you an information that you no longer rent certain accommodation or objection for your personal data processing by us on the basis of legitimate interest.

After the expiry of the retention period, we will either delete, destroy or anonymise the personal data collected. Some personal data stored in computer files may still be accessible for a certain period of time after the expiry of their retention period in data backup systems, but access to such personal data is strictly limited.

SECURITY OF PERSONAL DATA

We take appropriate technical and administrative measures to protect the personal data we collect from loss, unauthorised use and alteration.

CONFIDENTIALITY

We process all personal data strictly in accordance with the principle of confidentiality.

TO WHOM WE TRANSFER YOUR PERSONAL DATA

As a general rule, we do not share your personal data with others. However, in order to fulfil our obligations, we may transfer personal data to partners acting on our behalf.

If you are a person who rents accommodation:

  • when sending automatic inquiry generated on the website, once you reply to such automatic enquiry user of the website will get your e-mail details and also other information, which you decide to share with the user of the website. We note that we will not see any details of your communication with the user of the website, starting from the moment you reply to the user of the website;
  • the users of the website will see information about your accommodation published as to be rented on various other websites and collected by our website from such various other websites.

If you are the user of the website, we will only see the first automatic inquiry which is generated automatically on the website and sent to the accommodation landlord (if you decide to reach him). We note that we will not see any details of your communication with the accommodation landlord, starting from the moment the landlord replies to you.

We may also transfer personal data we collect to the following recipients:

  • persons providing legal services to us;
  • persons providing financial/accounting services to us, other service providers and consultants;
  • payment service providers;
  • roomRadius data processors;
  • public authorities, law enforcement agencies and other persons in accordance with the procedure established by the applicable legislation;
  • other persons (including prospective purchasers of the business of roomRadius) in connection with the sale, merger, purchase of the business or part of the business of roomRadius.

With your consent, we may also provide personal data to other persons.

When we transfer personal data to other persons, we ensure the security of the personal data transferred.

As a rule, your personal data is processed in the European Economic Area (EEA). However, if there is a need to transfer the data out of EEA, we follow GDPR requirements regulating such transfers.

Personal Data Processors

In order to fulfil our obligations to you and to ensure the operation of the roomRadius, we may engage data processors who will process personal data in accordance with our instructions and to the extent determined by us, to the extent necessary to achieve the purposes of the processing of personal data.

We require processors to have appropriate organisational and technical security measures in place to ensure the security and confidentiality of personal data.

RIGHTS OF THE DATA SUBJECT

You may exercise your rights as a data subject by contacting us at the address set out in the Privacy Policy above, by e-mail.

This Privacy Policy implements your right to know (be informed) about the processing of your personal data.

You have the right to know what and how your personal data is processed. Upon your request, we will provide you with information on where we have obtained your personal data, the period of storage of your personal data, what personal data has been collected, for what purpose we process it, to whom we provide it.

We will normally provide you with such information free of charge, unless your requests are manifestly unfounded or disproportionate, in particular because of their repetitive content. If you are a landlord of the accommodation this right to object will be indicated in the first automatic enquiry for the accommodation generated through the website.

You have the right to withdraw your consent to processing.

You may request the erasure of all the data we have collected in order to exercise your right to be “forgotten”, but we have the right to refuse to comply with such a request in the cases provided for by law.

You have the right to request that the personal data you have provided us with, where it is processed on the basis of consent or a contract, and where it is processed by automated means, be “portable”, i.e. transferred to another controller or transmitted to you in a structured, commonly used and computer-readable format, where this is technically feasible.

You have the right to object to automated processing, including profiling. As a general rule, we do not take decisions with respect to you based on automated processing of personal data. If we do make such decisions, we will, at your request, carry out a review of the decision and an assessment of all relevant data.

If you have doubts about the lawfulness of our processing of your personal data or if you are not satisfied with the resolution of the situation, you have the right to lodge a complaint about the processing of your personal data with the State Data Protection Inspectorate (L. roomRadius has established social networking account on LinkedIn.

Legal basis for processing of personal data through social network account: Article 6(1)(f) GDPR (processing is necessary for the legitimate interests of the company to ensure the development of its business).

All the information you receive when you visit our accounts on social networks is controlled by the social network managers and we recommend that you read their privacy notices. The types of data collected by social network managers are specified in the privacy policies adopted by the social network managers. The amount of data that roomRadius receives from social networks depends on the account settings you have selected, the agreements you have with social network managers to order additional services, and the cookies set by social network managers.

As the administrator of the social accounts roomRadius chooses the relevant settings, but the social network manager may have been restricted the possibility to change certain essential settings and thus we cannot control what information the social network manager will collect about you. If you view our social media posts, the social media manager may receive certain personal information unrelated to our activities, such as which terminal device you are using and your IP address.

Our website uses plug-ins to direct users to roomRadius accounts on the social network LinkedIn.

By clicking icons of the plugins on LinkedIn, you are redirected to LinkedIn page of the plugin manager and the plugin manager roomRadius is provided with the data which indicates the page that the request was made from, the time and date of the request.

The information that a person submits on the page of a plugin manager or that a person receives when visiting the links of the plugins on our website is controlled by the plugin managers and we recommend that you read their privacy notices.
